Governor Snyder, Ambassador Bridge owners duel over Proposal 6, new bridge

Governor Rick Snyder is focused on the Michigan ballot with two weeks to go before Election Day.

On Monday, Snyder appeared alongside Canadian consul general Roy Norton at a Canada-United States Business Association meeting town hall in Detroit.

Both men asked Michigan and Canadian business leaders to support the proposed New International Trade Crossing. And both urged a “no” vote on Proposal 6, which would require a statewide referendum on any new international crossings. He says he’s in “campaign mode.”

After eight years in the making, and unmaking, Gateway project opens

Construction on the Gateway Project started in 2004. The $258 million construction project was supposed to be finished years ago, but a partnership between the Ambassador Bridge owners and the Michigan Department of Transportation broke down. A court determined the owners were not holding up their end of the bargain, and pulled them off the project. Today, another milestone passes in the saga as the Gateway Project opens.
With the periodic honk of semi horns echoing past, onlookers on a service drive today celebrated the opening of freeway ramps from I-75 as part of the long-delayed Gateway Project.

Little support for twin span, but Ambassador Bridge owners still push to keep permit

The twin span idea has been rejected by both Governor Snyder and Canadian officials. They’ve already signed a deal to build a new bridge, the so-called New International Trade Crossing, further downriver.

Bridge foes say referendum on New International Trade Crossing will be on the November ballot

A group that opposes efforts to build a new bridge connecting Detroit and Windsor says it’s well on its way to putting that question on the November ballot.

“The People Should Decide Ballot committee” says it’s collected more than 420,000 petition signatures in favor of a voter referendum.

If passed, the measure would implement a constitutional amendment requiring Michigan voters to approve any new international crossings.

Governor Snyder and Canadian officials signed an agreement to build a new crossing just last week. That's after Snyder's efforts to get the project through the state legislature failed last year.

State announces milestone in long-delayed Gateway Project

State officials celebrated a major milestone toward finishing the long-delayed Gateway Project Tuesday.

They opened a road that will route trucks directly to the Ambassador Bridge from surrounding highways.

The Gateway Project is meant to better connect the bridge and highways. It’s also supposed to keep heavy truck traffic out of southwest Detroit neighborhoods.

Gateway Project: Thousands of trucks moving off streets in southwest Detroit

As part of the work on the "Gateway Project," the Michigan Department of Transportation opened an access road that will move truck traffic coming from Canada over the Ambassador Bridge directly on to nearby highways.

Prior to the road opening, trucks had to drive on secondary streets in southwest Detroit to get to the highways.

The Detroit Free Press reports the road opened yesterday, and a ceremony for the opening is planned for today.

The Detroit News reports the opening comes 5 days ahead of schedule, but because of the legal battles around the Gateway Project, the road opening is really years behind schedule.

In actuality, the opening of the access road comes about four years behind schedule because of protracted legal battles between MDOT and the Detroit International Bridge Co. over the $230 million Gateway Project.

When completely finished, the project will remove up to 10,000 trucks a day from secondary streets in southwest Detroit and move them directly to and from the Ambassador Bridge plaza to nearby freeways.

The project was supposed to be a partnership between MDOT and the Detroit International Bridge Company, but a judge found the DIBC to be in civil contempt of court after the company didn't follow the judge's orders to complete the project.

On March 8, the judge ordered the DIBC to cede control of its portion of the project and ordered MDOT to complete the remaining work.

MDOT says 95 percent of the new truck route is completed, and about 20 percent of the overall project is completed. When will it be finished? MDOT says their goal is to be done with the project "within a year and hopefully much sooner."

Language approved to put bridge question on the November ballot

A state board has approved ballot language proposed by the owners of the Ambassador Bridge.

They hope voters in November say “yes” to the measure that reads, in part: “The People should decide whether state government may construct or finance new international bridges or tunnels for motor vehicles.”

Matthew Moroun is Vice Chair of the Detroit International Bridge Company. He says the public can decide the ongoing dispute over whether to build a new bridge once and for all.

Ambassador Bridge referendum effort is a challenge to Governor Snyder

It’s no secret the Ambassador Bridge’s owners don’t want the state to build a new bridge between Detroit and Canada.

Now, the Detroit International Bridge Company is trying another tactic to make sure that doesn’t happen: a ballot referendum.

The Bridge Company has proposed language that would require state lawmakers to put any proposed international crossing up for a popular vote first.

Detroit closes Riverside Park; some suspicious of contamination claims

The city of Detroit is temporarily closing Riverside Park in southwest Detroit because it sits on contaminated land.

But some residents are suspicious, because the park is no stranger to controversy.

Riverside Park sits next to the Ambassador Bridge. In 2002, the Detroit International Bridge Company fenced off part of the park, supposedly for security reasons.

After years of legal wrangling, the city evicted them and re-claimed the park for public use.

Judge rules Moroun, Bridge Company officials no longer in contempt of court

Wayne County Circuit Judge Prentis Edwards lifted the civil contempt finding against the Ambassador Bridge owners today, saying they had been complying with his orders to turn the disputed Gateway project over to the Michigan Department of Transportation.

The ruling means that bridge owners Manuel (Matty) Moroun, his son Matthew, and bridge company president Dan Stamper are no longer under threat of jailing and no longer are required to attend subsequent court hearings in the case.

Judge strips power from Ambassador Bridge owners in construction dispute

A judge has stripped the company that owns the Ambassador Bridge of control over a key construction project, and transferred total control to the project’s joint partner, the Michigan Department of Transportation.

Ambassador Bridge owners say they'll comply with court order

Detroit International Bridge Company (DIBC) President Dan Stamper and Matty Moroun's son, Matthew, appeared before Judge Prentis Edwards in Wayne County Circuit Court today.

Both pledged that DIBC will comply with Edwards' order, and complete the Gateway Project according to specifications.

And both swore to cede power over the Gateway Project to a "special committee" as outlined in Michigan law--one that will include Stamper, but will otherwise be made up of outsiders.

DIBC lawyer Godfrey Dillard says his clients are doing what they can to "purge themselves of the contempt" charges that landed Stamper and Matty Moroun in jail briefly last month. But they still think the underlying court order is wrong--and will appeal that separately.

Dillard says the company has already started "de-construction" on their portion of the Gateway Project in order to comply.

But Tony Kratofil, Metro Region engineer for M-DOT, says it's "too soon to tell" whether all of this adds up to DIBC acting in good faith.

"It all sounds very good on the surface, but  we’ll see what actions play out in the next month,” Kratofil said.

Another hearing to monitor progress is scheduled for March 8th before Judge Edwards.

The company that owns the Ambassador Bridge says it will comply with a court order—and give up a years-long legal battle over a disputed construction project.

The announcement comes ahead of a scheduled hearing in Wayne County Circuit Court Thursday.

But the Detroit International Bridge Company won’t use it to keep fighting the February, 2010 court decision ordering them to finish the long-delayed Gateway Project.

That's a joint construction project with the Michigan Department of Transportation, meant to better connect the bridge with surrounding highways.

Instead, Bridge Company officials say they'll use the hearing to detail how they plan to comply.

The ongoing battle between the DIBC and MDOT landed DIBC President Dan Stamper and bridge owner Manuel "Matty" Moroun in jail overnight for civil contempt of court last month. Last week, the Michigan Court of Appeals upheld the lower court judge's right to incarcerate the two men, though not indefinitely.

Stamper admits the idea of returning there motivated them to cooperate. “It entered into all of our thoughts,” said Stamper.

Moroun's son, Matthew, added: "I don’t think any human being likes jail.”

Matthew Moroun says he and his father will also cede decision-making powers for the Gateway Project to a "special committee." They say that committee will include Stamper, but otherwise be made up of people from outside the DIBC.

Although they've now agreed to comply with, the DIBC continues to insist the court order is wrong. They've blamed MDOT all along for the construction delays, despite the court's decision and the findings of an independent monitor.

Appeals court says Moroun's jailing o.k. in dispute over Ambassador Bridge

A three judge panel from the Michigan Court of Appeals has ruled that Wayne County Circuit Court Judge Prentis Edwards used his power appropriately when he jailed billionaire Ambassador Bridge owner Manuel "Matty" Moroun and his top company official, Detroit International Bridge Company President Dan Stamper, on January 12, 2012.

However, the court did say Judge Edwards didn't make the conditions of their release clear enough.

Lawyers representing Moroun and Stamper argued that their imprisonment was an improper use of the civil contempt of court power and "was invalid as a matter of law."

From the opinion of the Michigan Court of Appeals:

We disagree with appellants to the extent that they argue that incarceration was an improper use of the trial court’s civil contempt power; however, we agree with appellants that the trial court erred in requiring their continued incarceration until DIBC “fully complied with” the February 1, 2010, order...

Confinement or imprisonment may be imposed whether the contempt is civil or criminal in nature. Borden v Borden, 67 Mich App 45, 48; 239 NW2d 757 (1976). In the civil context, the confinement must be conditional.

The other two judges on the panel agreed with most of the decision, but not all. You can read Judge Fort Hood's opinion and Judge Wilder's opinion.

Moroun and Stamper were freed on appeal by the Michigan Court of Appeals on January 13 after spending the night in a county jail.

Now, after this Appeals Court ruling, the two top Ambassador Bridge officials will return to Wayne County Circuit Court this week.

And they’ll do so facing the possibility they could go back to jail if Judge Edwards crafts a new civil contempt of court order.

The whole issue stems from a dispute over the Gateway Project, a joint construction project between the DIBC and the Michigan Department of Transportation. The project was meant to build ramps that would better connect the Ambassador Bridge to surrounding highways, and keep truck traffic off residential streets.

The Appeals Court ruled that Edwards was within his rights when he ordered the two to jail. But they maintain Prentis's order that the two remain incarcerated until the Gateway Project is "complete"--something that will likely take months--was too vague.

The Appeals Court judges said Edwards would have to provide specifics on how Moroun and Stamper can remove the civil contempt of court ruling.

A Michigan Department of Transportation spokesman says the agency is pleased with the ruling, and is “eager” to see the more specific conditions the Judge lays out.

The Detroit International Bridge Company released a statement that was silent on most of the ruling, but noted the DIBC is "pleased with the recognition by the MI Court of Appeals today that the Ambassador Bridge Gateway Project must be finished." It went on to say:

"Given the events since the Court of Appeals accepted the appeal from Judge Edward’s order, MDOT announced its intent to begin completion of MDOT’s unfinished ramp. It is very clear that MDOT has held up construction, not DIBC...No one wants the Gateway completed more than us."

But a report from a court-appointed monitor who studied the Gateway dispute agrees largely with MDOT's position that the DIBC has held up the project.

A hearing before Judge Edwards is set for Thursday.

Appeals court frees billionaire bridge owner

The Michigan Court of Appeals has freed Ambassador Bridge owner Matty Moroun and his top aide, Dan Stamper from the Wayne County jail.

Thursday morning, Wayne County Judge Prentis Edwards sent Moroun and Stamper to jail for civil contempt of court.

That night, the Court of Appeals denied Moroun and Stamper’s emergency motions to get out of jail.

But their lawyers tweaked their argument today, and again asked that the two be freed while their clients’ appeal is pending. The court has now agreed to that.

Republican leaders say a bridge vote will happen this fall

State Republican leaders say they hope to move forward in October with a proposal to build a publically owned second bridge between Detroit and Canada.

Lieutenant Governor Brian Calley says a second bridge would benefit businesses throughout the state.

"Those entities that make things here, be they automobiles, furniture, chemicals, cereal or baby food or even Slinkys, all these things we make in Michigan, and agricultural products as well, Canadians buy more of that than anybody else in the world," said Calley.

He says a publically owned bridge that connects major highways on both sides of the river would keep exports streaming into Canada from Michigan.

Calley was on Mackinac Island over the weekend for a Michigan Republican Party conference.

He lobbied for the bridge project while there saying the bridge project is a conservative one that will be attractive to Republicans and Democrats alike.

The proposal has been unpopular with some Republicans who think a second bridge should be built by a private company. The owner of the existing bridge in Detroit was also at the Michigan Republican Party conference on Mackinac Island to try to influence lawmakers oppose a publically owned bridge.

Calley says he and Governor Rick Snyder are not deterred by campaigning against the project by the company that owns the existing bridge in Detroit.

"[We're] making very steady progress and feel good about the track that it's on right now," said Calley. "It's really always been more a matter of getting through all of the garbage on the TV ads, and simply articulating what the proposal is."

Calley says one of the biggest hurdles they face is countering the influence of the multi-million dollar ad campaign. The campaign is paid for by the owners of the existing Ambassador Bridge.

A little clarity in the muddy international bridge debate

A report from the Anderson Economic Group has offered some clarity to the debate over a new international bridge crossing between Detroit and Windsor.

A little background in case you have sat this story out thus far:

Governor Rick Snyder has been pushing the idea of a new bridge two miles south of the Ambassador Bridge, known as the New International  Trade Crossing (NITC).

It would connect up I-75 and Highway 401 in Canada.

The Ambassador Bridge owners, the Detroit International Bridge Company (DIBC), don't want competition from another bridge. Owner Manuel "Matty" Moroun has been fighting against the proposed bridge with a $4.7 million television ad blitz.

The ads say Michigan taxpayers could be on the hook for the costs of the New International  Trade Crossing if plans don't pan out.

Moroun is proposing to build a second span next to the Ambassador Bridge to ease congestion.

The report from the Anderson Economic Group analyzes both proposals (NITC vs. DIBC).

The bottom line of the report from several media reports out today is that the new bridge (NITC) would ease congestion currently felt at the Detroit-Windsor crossing, and a second span of the Ambassador Bridge would not (DIBC).

It's finding no. 2 in the report.

The Detroit International Bridge Co.'s proposed second bridge between Detroit and Canada would not eliminate the current congestion on both sides of the border but the New International Trade Crossing bridge would do so, according to an independent study released today by the Anderson Economic Group.

A proposed government-owned bridge over the Detroit River, with additional U.S. Customs booths, would do a better job reducing border traffic congestion and handling future traffic than a second Ambassador Bridge span, says a new independent report released today.

From the Detroit News:

A proposed bridge two miles south of the Ambassador Bridge would alleviate border congestion, but a new span beside the Ambassador would not, according to a study released Tuesday.

Finding no. 3 in the report states that the obligation to repay borrowed funds for the construction costs of either bridge does not rest with Michigan taxpayers. That finding assumes that protections for Michigan taxpayers are in place for "statute and bond covenants."
