Detroit Mayor hires firm to stop consent agreement challenge

Mayor Dave Bing has been trying to convince city council to join him in stopping the city's lead attorney from going forward with a legal challenge against the city's consent agreement with the state. Now he's hired lawyers of his own:

Mayor Dave Bing, exasperated by the lead city attorney's unwillingness to drop her challenge of the financial deal meant to spare Detroit from the appointment of an emergency manager, has brought in hired legal guns to try to quash her complaint.

Bing has hired attorneys from Miller Canfield -- the same law firm the mayor contracted to broker the consent deal with the state and a bond agreement that kept the city financially afloat -- to file a motion to intervene against the city's top lawyer, Krystal Crittendon, people familiar with the decision told the Free Press on condition they not be named because they're not authorized to speak on the issue.

Crittendonwill be in Ingham County Circuit  Court today where she's expected to request an expedited decision in the case.

Protests in Lansing over potential abortion legislation

Protestors opposing a set of bills aimed at putting restrictions on abortion were in Lansing yesterday. MPRN's Rick Pluta reported protestors said the bills would force some clinics that provide an array of services to women to shut down.

They were protesting a group of anti-abortion bills to be voted on this week by the House. The legislation would outlaw terminating a pregnancy after 20 weeks. It would also require clinics to be inspected, and impose new restrictions on abortion providers.           

“Frankly, these bills terrify me,” said Susie Simons of East Lansing.

Announcement on new bridge to Canada expected

Since he's become Governor, Rick Snyder has been pushing for a second bridge linking Detroit to Canada. Now it appears plans for that second bridge are coming together.

A deal to build a second bridge linking Windsor and Detroit will be announced this week, sparking hope that the chronic congestion at Canada’s busiest border crossing will soon be relieved.

Prime Minister Stephen Harper is expected to join with Michigan Governor Rick Snyder on the Windsor waterfront for the official announcement on Friday, a source told the Toronto Star Tuesday.

Detroit International Bridge Company found in contempt of court

A Judge has found the company that owns the Ambassador Bridge in contempt of court.

Update 2:17 p.m.

Here's an update from the Associated Press with reaction from the Ambassador Bridge owners:

DETROIT (AP) - The company that owns the Ambassador Bridge says a judge is wrong to find it in contempt for failing to finish work on a project linking the U.S.-Canada span with two Detroit interstates.

Wayne County Judge Prentis Edwards will wait until Jan. 12 to order a penalty, but he wants bridge owner Manuel "Matty" Maroun at that hearing.

Detroit International Bridge Company says piers have been properly built and more work will be completed by January. It says it will appeal the judge's contempt order announced Thursday.

The state of Michigan sued the company after it failed to meet a deadline to finish its part of a $230 million project to improve traffic at the bridge linking Detroit and Ontario.

A New Detroit River Bridge: Bump in the Bridge Bills

So what happened yesterday?

For months, everybody interested in the possibility of a new bridge over the Detroit River had waited for the State Senate Economic Development Committee to take a vote.

Not that this would settle much of anything -- except to decide whether to let the full senate decide whether to vote. Most of the committee members have taken political contributions from the owner of the ancient Ambassador Bridge, Matty Moroun.

A New Bridge Across the Detroit River: Conflict of Interest?

Here’s something you may not know about journalists: We have a pretty high standard of integrity, especially when it comes to conflicts of interest. We normally don’t cover any events in which we have any kind of personal interest -- especially economic interest.

Any time we even suspect we may have any conflict, we are obliged to tell our bosses, and our public. There are some gray areas, but I can tell you this. If I did a commentary urging you to support someone who gave me thousands of dollars, I’d be fired.

Lt. Gov Calley to meet with Detroit City Council to discuss proposed new bridge

Lt. Gov. Brian Calley is scheduled to meet with the Detroit City Council this afternoon to discuss a proposed new bridge that would span the Detroit River. Governor Snyder is pushing for the new bridge which would connect Detroit to Windsor, Ontario. Many state Republican lawmakers oppose the plan, known as the New International Trade Crossing. The owner of the Ambassador Bridge, which connects Detroit to Ontario, and is the busiest international trade crossing in North America, opposes the plan as well. He wants to build a new span of his own.

As the Detroit Free Press explains this morning, “…just about everyone involved in Michigan's great bridge debate supports building some new bridge to replace or supplement the Ambassador. The question boils down to who would build it and own it -- Ambassador owner Manuel (Matty) Moroun as a private businessman or the citizens of Michigan and Canada through public authorities.”

As the Associated Press notes:

Gov. Rick Snyder and many businesses want to build a new Detroit-Windsor bridge to aid passenger and commercial traffic. It would be backed by private investors, and Michigan would rely on $550 million from Canada for related improvements.

It's likely Calley will use the meeting to try to gain support from the City Council for the New International Trade Crossing.

Selling the Bridge

Our lawmakers are preparing to wind up business for the summer, and Governor Rick Snyder has racked up an astonishing record of legislative success. True, his party has heavy majorities in both houses, and there was a broad consensus that Michigan needed change. But he got lawmakers to agree very quickly to major reforms that faced entrenched opposition.

Taxing pensions, for one thing. True, he had to compromise, finally agreeing to exempt most of those already receiving them. But that he got Republicans to agree to a tax increase at all was something like getting a vegan to eat a hamburger.

The changes in the Emergency Financial Manager law and in the rules covering binding arbitration for government employees will have profound effects in years to come.

In six months, this governor has accomplished more than his predecessor did in four years. But he has so far failed at one thing, something that would have seemed an easy sell.

The proposal to build a new bridge across the Detroit River,  the New International Trade Crossing. The facts indicate this should be a no-brainer. The Ambassador Bridge is old. Canada wants and needs a new bridge so much it will cover all Michigan‘s costs.

Not only that. The federal government will allow Michigan to use the $550 million Canada is offering us as matching money to get two billion dollars in badly needed federal highway funds.

Yet the governor had to postpone a vote on the bridge because he’s been unable to win over most in his own party. To understand their thinking, I talked yesterday with one of the rising stars in the Michigan Republican Party, Senator Tonya Schuitmaker.

Matt Moroun testifies against new bridge crossing

A member of the family that owns the Ambassador Bridge between Detroit and Canada testified before a state Senate committee in Lansing today.

He spoke with a handful of lawmakers who appear annoyed by conflicting information.

Matt Moroun told lawmakers that a proposal to build a publically owned bridge between Detroit and Canada is unnecessary because traffic is down, and tolls would not cover the construction costs.

But he also says the company is prepared to build a second bridge.

That prompted this question from Republican state Senator Geoff Hansen:

“If you receive a permit, will you build a second span?”

Moroun answered:

“The next day we’ll start. Promise.”

Republican state Senator Mike Nofs asked why the Ambassador Bridge owners would want to build a second bridge.

“Why would you build a second bridge the next day if you can’t make the money? The tolls aren’t going to be there. The traffic isn’t going to be there," Nofs said. "It’s going to cost you a lot more money, and you have to expand the roadways on both sides, and you have a government against you apparently right now - Canada - why would you build a second span?”

Moroun says his family’s company needs to build another bridge because the Ambassador Bridge is about 80 years old, and costs a lot of money to maintain.

Democratic state Senator Virgil Smith from Detroit says the Ambassador Bridge owners are controversial figures in the city.

“If you want to proceed with this – with the new project, with the new bridge – I think you’re going to have to clean up a number of your actions in southeast Michigan to do so, or I don’t see it happening no time soon," Smith said.

Many state senators expressed frustration with what they view as a slew of contradictory studies about whether a publically owned bridge would be profitable to taxpayers, or a burden.

Hearings on the bridge issue will continue next week.

"Eviction notices" shake Detroit community

Residents in a Southwest Detroit neighborhood found what appeared to be eviction notices on their front doors Monday.

The notices were actually flyers distributed by the group Americans for Prosperity in the city’s Delray neighborhood.

The flyers warned residents that the state will seize their homes, if legislators approve a plan for a new bridge connecting Detroit and Windsor.

Four former Michigan governors have come out in support of Governor Rick Snyder's plan to build a new bridge from Detroit to Windsor, Ontario. The Snyder administration put out a news release yesterday saying Democrat Jennifer Granholm, Republican John Engler, Democrat James Blanchard, and Republican William Milliken all support the Detroit River International Crossing (DRIC).

Canadian environmental group fights new border crossing

The Ambassador Bridge between Detroit and Windsor

A Canadian environmental group says studies supporting the proposed Detroit River International Crossing (DRIC) are flawed.

DRIC supporters on both sides of the border say a new crossing will create jobs and bolster international trade.

The Canadian and Ontario governments strongly support the project, and Governor Snyder recently voiced his approval too.

But a Sierra Club of Ontario report says the traffic projections DRIC supporters cite are flawed. They say cross-border traffic has declined for 12 years, and shows no sign of rebounding anytime soon.
Sierra Club director Dan McDermott says the DRIC would be a costly boondoggle.

“There is simply no demand for DRIC. No cross-border traffic demand that justifies five-plus billions of dollars.”

McDermott says he hopes the report will bolster its cases against the DRIC in Canadian courts. Those lawsuits challenge the project’s environmental permits.

Legislation on new Detroit-Windsor bridge to be introduced in state Senate

State Senator Hoon Yung Hopgood said yesterday that he is sponsoring a bill that would be connected to the effort to build a new international bridge from Michigan to Windsor, Ontario. The Democratic lawmaker's statement follows Governor Rick Snyder's announcement that he supports the Detroit River International Crossing (DRIC). Snyder announced his support on Wednesday evening during his first State of the State address.

As the Associated Press reports:

U.S. Transportation Secretary Ray LaHood said Thursday the project is "absolutely critical" to trade with Canada. Some Republicans and the owners of the private Ambassador Bridge connecting Detroit and Windsor have opposed the proposal.

A statement released after the State of the State address on Senator Hopgood's website noted:

State Senator Hoon-Yung Hopgood (D-Taylor) is backing Governor Rick Snyder's measure to support the Detroit River International Crossing, which could create thousands of jobs and boost Michigan's economy. According to state officials, the project could create 10,000 jobs directly and 30,000 additional jobs through related economic activity...

The Canadian government has offered to pay up to $550 million to cover Michigan's cost to build the new bridge between the U.S. and Canada. This agreement mirrors the agreement to build the Blue Water Bridge. The U.S. paid for that bridge and Canada's offer to cover this investment is in the same spirit of cooperation. Canada will be repaid – as Michigan was – through tolls collected from bridge users.
